fully favorable decision

    I finally got a decision in my case and it was fully favorable.

    The judge said every claim was valid that I made and from what I understand he is one of the hardest to get a favorable decision from.

    I am so happy I am just hoping my hubby don't make too much money for me to get some money.

    Congrats on the decision. What do you have CFS or FM? How long did the process take?

    I have fm and it has taken me three years.

    Congrats on winning your appeal before the ALJ! It seems
    to me that the SSA considers your financial situation be-
    fore ever allowing you to continue on with the case. If
    your husband's income is about the same as when you started
    ,
    there should not be a problem. Maybe someone else will
    correct me if I'm wrong. But I think they determine that
    in the very beginning.

    Pamela,,,,
    Are you talking about SSDI??? (Social Security Disabilty) If you are,,,your husbands income has no bearing whatsover with your case.You have paid this money into the system yourself when you worked.

    BUT,,,,if you are talking about SSI (Supplemental Security Income)then his income DOES have to be below a certain amount.

    Some people are eligible to receive both SSDI and SSI.

    I have been on Social Security Disability about 5 years now. I receive help from the state to pay my Medicare Premium and my Presciption Plan.

    Dear Pamela:

    Congrats on your decision. As another poster stated, if you are talking about SSDI, your husband's income has no bearing on your award or your monthly payment. SSI is the only program that has limitations on the assets you can have.

    Enjoy your newfound wealth (ha, ha).

    yippee..job well done...same thing as the others on the ssi deal...if that is the case..there have been married people who legally separate...by papers only just to make due...so if that is what you need to do...then go for it...

    I worked a lot in my life just not recently enough to have it count now.

    After the birth of my Son I have worked some off and on but that was the point where I started having fms problems.

    That was almost 13yrs ago.
