Help with Filing Disibility

    Hi all.

    I have filed for it with a company named Allsup out of Ill. They will be doing all the work, etc.

    I would like to know from you all...1) have you heard any pros/cons about Allsup, and 2) should I just go and hire a lawyer?

    Please help cause this is all new and I want more than anything to do this process right.

    Allsup wasn't getting all my paperwork filed....long story short, pertinent information that the case manager needed didn't get to him and he didn't think he had enough information to win my case and he dropped me as a client.

    I was so upset thinking I didn't have a good case...fortunately I contacted a local attorney and she reviewed all my information and said that I had plenty of good information.

    The case manager didn't have all the information needed to make a decision to drop me and I almost dropped the whole thing.

    Needless to say....I think Allsup is a people mill moving client in and out of the door. Making poor decisions.

    Now...many, many people have had good results with Allsup, so perhaps what happened to me was an isolated event but I like to worn those who ask what happened to me so they know to contact an attorney if they have problems with Allsup.

    Sorry to hearabout yer gig with Allsup.
    1. How long did Allsup have yer case before they dropped you and,
    2. How long did you have to wait till yer lawyer won yer case?

    Now Im scared and dont know what I should do.....

    Ox, you will need to get a attorney who specializes in social security disability only.
    One big thing you may need to consider is a question you may be asked is ,
    how can you be drawing unemployment (looking for work) when you are considering to file that you are disabled and can not work and need social security disability ?

    you've read/heard that you must have an attorney. An attorney greatly increases your
    chances of winning your case in a shorter time.

    The board used to recommend an attorney in Arizona. Can't remember very well anymore.
    I think his name was Scott Davis of Scottsdale. Anyway his office handled cases all
    over the country.

    Can't find the info on the new board. Good luck.

    it can take 24-36 months to actually win a SSDI case....depending on your state. I would check out the tab at the top of the FM boards home page for the disability information. It has some good stuff.

    Oh, I was with Allsup for about a year?!? Dumb Donkeys!!

    Talk to an attorney if you have doubts...But I do want to stress that many on this board have had good luck with Allsup. I hate to think you are losing sleep that we all so desperately need!

    Because I have lost the last 2 or 3 jobs from this fibro. To bring in money, I filed for unemp insurance that I HELPED to set up by my contributions into it. Yeah, I follow the rules and apply to 2 different jobs as required to every week.

    Just because Im getting unemp does NOT mean im notdisabled. It means I just lost my latest job due to fibro, post tramatic stress, severe muscle tremmers, severe fibro fog and memory loss, and excrutiating pain. Oh, and cripplying panic attacks AND sleep apnea.

    Dows THAT perhaps answer your question?

    So, then, most of you think I should get a lawyer? To the person who answered that they were with ALLSUP for over a year, why was that? What was their reasoning for a year long wait?

    Because during that time they acquire all you doctors records....fill out the paperwork, and whatever else they do.

    During that last few months I started see a new specialist (the one I am currently seeing), Allsup made the decision to drop me before they EVEN saw his report that they sent to him!!

    And then LIED and said they had....but when I requested my well as when my attorney requested my record it wasn't in there. So they lost it...never review it...then lied and said he did!!!

    I can't in good conscious recommend them to anyone.

    Not here of course, some other way. Please Deb, I need all the help I can get!!
    Oh..did you find out why Allsup dropped you even before they saw the persons report?

    I am dealing with Bott and Spencer....but they are located in Grand Rapids, MI, or close anyway!

    Allsup dropped me because I didn't have enough documentation...(although they lost the documentation they were looking for)...I didn't know they hadn't seen the reports from the specialist until I received a copy of my records and they weren't included.

    I only called an attorney because of that error....otherwise I'm not sure what I would have done. I'd call an attorney and at least ask for an opinion.

    Hi. I am currently applying for disability through Allsup. I have not had a problem with them. I was denied at the initital level and am currently awaiting a judge. The state I live in doesn't have level two, the reconsideration level.

    Can you share with me why you got denied? And how long did you wait till they finally looked at yer claim that led to the denial?

    Please give Allsup a try. It worked very well and within 6 months for me. I met another woman online who, like me, just 40 and she recommended Allsup.

    It was easy, and I am so grateful for their services. They did all the work and took all the stress out of it. I found out I won by finding a huge deposit in my checking account. Allsup was not yet aware of my approval, I let them know.

    I don't know if it matters, but I am in California and so was the person who recommended their services.

    Now, I may be wrong, but unless one has documented proof that they have lost a job because of an illness, (like your supervisor making note of your absences, inability to do specific parts of your job, etc.), and you having dr.s notes explaining that your absences were due to fibro, it may be an uphill battle for you to claim disability.

    Of course, if you have these, you are going to have an easier time of it.

    Also, even though your past work makes you eligible for unemployment, I do also believe you can't be "disabled" and unable to do comparable, gainful work, and claim you are looking for work. Did I explain that right? Clearly?

    I used a well-known disability lawyer in my hometown, but it took me two appeals and an administrative law judge before I was approved 1-1/2 yrs later. If I had not had a spouse to support me, I would have been in a world of hurt.

    If you call 1-800-772-1213, they automatically enroll you for welfare (SSI)and Medicaid at the same time you apply for SSDI. You can be approved for the SSI very quickly, and hopefully can survive on a small income, food stamps and Medicaid until your SSDI comes through.

    One caveat; once you get approved, you have to wait 2 years for Medicare, and I don't know if you can still have Medicaid during that period....ask about that when you call. I do think if you don't have substantial earnings over the years, your SSDI benefit can be low enough in some states to qualify you for some SSI benefits also, especially to pay for your Medicare when it comes through.

    Have you looked at the "Social Security" heading at the top of the page? (The one's in dark blue are the most often discussed topics.) There is a wealth of information there.

    Best of luck to you in your battle for disability; those with FM can have quite a battle on their hands because unless you have tried so many different meds to try to control the pain, without success, one may be denied. So, the thee (pun intended) to as many drs as you can to document all the various problems FM can cause you: severe pain, sleep disorders, overwhelming fatigue from the above two, cognitive problems...well, you get the picture, I'm sure.

    Do you have any "job descriptions" of what you've been doing for a living? If so, take them and document what symptom keeps you from doing each task.

    Keep excellent records of all drs., treatments, results, next dr, etc. Start right now keeping good records, it will be invaluable.

    Yes, I have mounds of the documents you mentioned.

    I am not just applying cause of fibro - also Sleep Ap, Anxiety probs, Post Tramatic stress, sever muscle spazums, Extreme fibro fog, memory loss, extreme fibro fatigue, to name a few. Thanks for the advice for the welfare gig.

    And thanks to the cool person who wrote before skeptic did. Allsup said I stand a great chance of getting it because of my many health probs.

    It was Daefofan....Im really glad Allsup did all the work for you, as they are doing for me. In the shape Im in, I could not do anything. Cant remember crap, cant spell ( !! ) Im just all dead from all the above mentioned issues and a few I did not mention.

    I am not a person who lies, but for 2 to 3 yrs I told my husband that I applied. Actually I had just ordered the paperwork from the local SS office. I never did anything with it. I told him it just takes a real long time. I was too overwhelmed.

    Finally after meeting a friend, on of all things a makeup website, we started corresponding and she told me her job actually hired Allsup for her. I inquired, talked to them, and only had to fill out one set of papers and discuss it all with my rep on the phone.

    I don't know you situation, but I am married and my DH and I both made good $$. I think the fact that I worked at the same place for 20 yrs helped and having had no college education and working my way up to Management might have made it obvious I wasn't a complete flake (even if I felt like one).

    I was never told why I was approved, but I believe it was more for the stress and psychiatrist visits as much as the rheumy. My Husband wrote a pretty compelling letter about what I used to do and what I could do at the time of application. Believe me it was about 10% of what I used to do. If you don't have a spouse, have someone who knows you very well and really can explain what changes they have seen in you.

    I never got any papers together from Doctors, only gave them Dr. names, meds I took/tried, and what I used to be able to do and can't anymore (such as lifting, sitting, bending, etc.)

    Best of Luck, I'm so sorry for those who didn't have good luck with them. I felt it was one of the smoothest things I've been thru. They even said they considered me to be disabled from the day I left work, so I lost out on a lot of back pay (as they only go back one year of filing). All-in-all removing the stress is the best thing in the world.

    To the person that asked if I saw the Social Security heafer in blue at the top of this page...unless Im really having a bad day. I dont see it anywhere. Can you expand as to where this topic is at?
