Questions for those people on disability from work

    Hi everyone
    I am in the process of appealing my disability insurance company. I am not sure of what the difference is between LTD from an insurance company and our Canadian disability, or even the U.S. disability plans. My question is firstly, how many won your disability on depression and how many on Fibromyalgia, secondly, if it was on depression and your psychiatrist or dr. has put you on meds to help your depression (mood, thinking, energy ) like say Wellbutrin,and celexa then why wouldn't the disability companies not just tell you "You can go back to work now, as your dr has stabilized you". I am afraid that once my psychiatrist has my depression and anxiety under control that she and the insurance company will think I can go back to work if I win on depression even though the fibro pain is so bad. Am I being paranoid, can this happen??

    I won my STD and LTD from the insurance co that my old place of employment provided. I won on the basis of FM and not depression. My psychologist wrote a detailed letter explaining that I was not depressed, and I had three docs 2 of which were rheumys and 1 nuero all in agreement that this DD has stolen my life and left me disabled. Of coarse all of the documentation was sent in for the appeal process.

    to qualify for Pension disability. I won with the FM from my pc and my rheumatologist. Im still fighting for SSD.

    The LTD work disability is much harder to get and to keep than the government disability. Its best to put more into the fibromyalagia as with just depression they usually cut you off after 2 years. Use both conditions. You need a good family doctor and specialist backing you. Be prepared for a fight. It took almost a year for me to get approved and I had cancer too. Then at 2 years they cut me off saying I had to prove I was disabled from any job not just mine. I had to hire a lawyer and sue them. I won a buy out. I got a little more than half of what they would have paid me to full term. Thats usually how it goes. Its rare that you get reinstated and stay on it. There motto is deny, deny , deny. A good lawyer wont charge you any fee until you settle then its usually 15 to 20 percent of the amount. The main thing is dont give up. They know that most people accept the denial and go away. So get a lawyer and fight them. Stick with the main disability as fibromyalgia and depression as a condition of the fibromyalgia. It is recognised now as disabling you just need to be prepared to fight for it. good luck

    After being a state employee for over 10 years, I won state disability fairly easily. First for 1 year, then re-eval. and won for 3 more years and then to be re-eval and if won then, will be for 7 more years. Low pay but better than nothing. Private LTD with state funded plan denied 5 times. They just made up stuff and the evaluating "board" was ignorant of illness. Waste of my premiums! I got an attorney and filed for Fed Dis. Denied several times. Now have waited 12 of 12-18 months for admin law judge. Attorney will get 40% if I win. We will see.

    wow my lawyer only took 15%.I won my governement disability case on my own. Took me about 2 years. I used my lawyer for my work disability that I too paid premiums for 27 years. What a scam it is. Any how I did get a good lump sum payment. Was able to pay off my house, buy a new car and put some money away. I was also lucky that I didnt lose my job. I was off sick for 4 years .Once all my law suits were over then I retired from work and collect my pension. It all worked out very well. It was so stressful going thru it all though. From the time I was off work until it all settled was 4 years. Thats not bad though from the horror stories I heard. I also had a car accident which I used the same lawyer and sued and again he only took 15% of that. I was very lucky.
